Terms and Conditions

Shree Skanda Creatives

These Terms and Conditions govern the provision of digital marketing, social media management, content creation, advertising, and related services provided by Shree Skanda Creatives (“Agency”) to its clients (“Client”).

By engaging the services of Shree Skanda Creatives, the Client agrees to the following terms.

1. Scope of Services

Shree Skanda Creatives will provide services as outlined in the proposal, quotation, or service agreement shared with the Client. Services may include but are not limited to:

Social media management
Content creation (graphics, videos, copywriting)
Digital advertising campaign management
Social media strategy and consulting
Online reputation management
Analytics and performance reporting

Any additional work outside the agreed scope will be treated as extra services and billed separately.

2. Payment Terms

All payments must be made in advance before the commencement of any services unless otherwise agreed in writing.
For recurring services such as social media management, payments must be made before the start of each billing cycle.
Failure to make timely payment may result in delay, suspension, or termination of services.

3. No Refund Policy

All payments made to Shree Skanda Creatives are non-refundable.
Once a payment has been processed, the amount will not be returned under any circumstances, including early termination by the Client.
Payments made for advertising spend, tools, or third-party services are also non-refundable.

4. Delivery and Removal of Services

Once services such as content, campaigns, posts, or digital assets are delivered, published, or implemented, they will not be removed, reversed, or taken down upon request unless mutually agreed and technically feasible.
The Agency reserves the right to retain copies of all creative work produced.

5. Client Responsibilities

The Client agrees to:

Provide timely access to required social media accounts, assets, and credentials.
Share necessary brand information, logos, images, and approvals on time.
Review and approve content within agreed timelines.

Any delay from the Client’s side may affect delivery timelines and performance.

6. Approval of Content

All content shared with the Client for review is deemed approved if no feedback is received within the specified approval timeframe (typically 48 hours unless otherwise stated).

Once approved or published, the Agency will not be responsible for errors or revisions requested afterward.

7. Advertising Spend

Advertising budgets for platforms such as social media or search engines are separate from the Agency’s service fee and must be funded by the Client in advance.

The Agency does not guarantee specific results such as:

Sales
Leads
Followers
Engagement metrics

as these depend on market factors and platform algorithms.

8. Intellectual Property

Upon full payment, the Client will receive rights to use the delivered content for their business.
Shree Skanda Creatives retains the right to showcase completed work in its portfolio, marketing materials, and case studies.

9. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the engagement.

10. Limitation of Liability

Shree Skanda Creatives shall not be held liable for:

Platform outages or policy changes
Account suspensions by social media platforms
Loss of revenue, business, or reputation due to digital campaigns

The Agency’s liability shall not exceed the amount paid for the service in question.

11. Termination

Either party may terminate the service agreement with written notice as specified in the proposal or contract.

However:

Payments already made remain non-refundable.
Work completed up to the termination date will be considered delivered.

12. Force Majeure

The Agency shall not be held responsible for delays or failure to perform services due to circumstances beyond its control, including natural disasters, technical outages, governmental actions, or other unforeseen events.

13. Governing Law and Jurisdiction

All legal matters, disputes, or claims arising out of services provided by Shree Skanda Creatives shall be governed by the laws of India.

Any disputes shall be exclusively subject to the jurisdiction of the Commercial Court Complex in Coimbatore, Tamil Nadu, India.

14. Acceptance of Terms

By engaging the services of Shree Skanda Creatives, making payment, or signing a proposal/quotation, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
